Terms Of Use
The following is a legal agreement between you and Celery Stock, Inc. Please read the agreement before downloading images. Celery Stock reserves the right to change the terms of this agreement at any time. By purchasing any image, you agree to the terms of this agreement.
1. All images on the Celery Stock website are protected by United International copyright laws and treaties. Celery Stock owns the copyrights to all images. Your rights to use any image are conditioned upon your payment to Celery Stock for your use of the Images. Failure to make any payment when due, or any credit refused or charged back will refute purchasers right to use images.
2. Celery Stock grants you a personal, non-transferable right to use and reproduce images provided that the images are not used function as a trademark, service mark, or logo. Any derivative work based on or images copyright will be owned by Celery Stock.
3. Celery Stock shall be under no obligation to refund your payment under any circumstances. However, in the event Celery Stock determines that you are entitled to a refund of all or part of your fee, such a refund shall only be made to the credit card account used to purchase the image.
Restrictions
You May Not:
4. Display or use any image on websites or in connection with any designed to sell or induce sale of images.
5. Use the image together with pornographic, defamatory, or other unlawful or immoral content or in a way that it infringes on a third party’s trademark or intellectual property.
6. Share an image by providing access to image on shared computer networks, intranets of any nature.
7. Use any image in part or whole as a trademark, or logo.
8. Resale Celery Stock images.
9. Use automated programs to download images.
10. You may not sell, rent, load, give or transfer the images to anyone. You agree to take all commercially responsible steps to prevent other parties from duplicating any image.
11. You agree to indemnify and hold Celery Stock, Inc, its officers, shareholders, directors and suppliers harmless against any liability of any kind arising from any use of the image. You further agree to indemnify Celery Stock for all costs and expenses that Celery Stock incurs in event that you breach any of the terms of this or any other agreement with Celery Stock.
12. Neither Celery Stock or any of its directors, officers, employees, licensors, or agents shall be liable for any damages whether direct or consequential, or incidental, arising out of the use of image or images.
13. Celery Stock does not warrant that the image(s) on the website will meet requirements or that use will be uninterrupted. The entire risk as to the quality, performance of the image(s) is solely with you.
Celery Stock shall not be liable to you or any entity for general, punitive, special, indirect, consequential, or incidental damages or lost profit arising out of your images.
